Guidelines and Procedures for Non-Compliance including Levels of Non-Compliance and the Resulting Outcomes

Purpose:

Events sponsored by student organizations, departments and off-campus entities are booked, set up, enforced and managed through the Student Center & Event Services office (SCES).

SCES also administers campus policies. Three levels of infractions are listed below by the degree of severity of the infraction. For each level, a consequence of the infraction is indicated.

Outcomes of Non-Compliance

A written notice of non-compliance will be given on site to those individuals/group members, and a copy of the non-compliant notification will be sent to the authorized signer(s) and organization lead(s) if not on site. Level II and Level III infractions involving a registered student organization will be reported to the Student Life & Leadership office and, and/or the Office of Student Conduct. UCIPD will be contacted whenever a state or federal law is violated.

Levels of Non-Compliance and Corresponding Outcomes:

Level I Infractions

  • Setup in a space without a reservation.
  • Setup in an incorrect location.
  • Using amplified sound without a permit, excessive noise, such as amplified sound or shouting. Exceeding allowable sound decibel levels (60dp inside the closest building)
  • Using sound beyond the permitted time limit.
  • Serving/selling food that is non-perishable without appropriate campus approvals.
  • Selling non-food items on University property without the required University permission(s).
  • Violating campus posting policies, including covering windows of meeting rooms.
  • Remaining in reserved space after scheduled end time.

Level I Outcome of Infraction

  1. First-time Level I non-compliance, a verbal warning will be given and the group/student will receive a directive to stop the non-compliant act.
  2. Continued non-compliance after verbal warning results in a written notice.
  3. Two written notices in one quarter will result in a change of the organization’s status from “Good Standing” to “Warning.”
  4. Any organization with a “Warning” status that receives a Level I violation or higher will be considered to be “Not In Good Standing,” and may resulting in loss of booking privileges for the remainder of the existing quarter. Appeals can be submitted to the Student Center Board of Advisors. The form and instructions on how to appeal can be found below.

Level II Infractions

  • Using a caterer that has not been approved by the University.
  • Purposely providing inaccurate event information (or withholding event details) in order to circumvent University policies or state, local or federal laws.
  • Having an off-campus vendor provide equipment or services in support of an event without obtaining the required insurance/documentation/permissions.
  • Animals without insurance and campus approval (exceptions are service and companion animals).
  • Filming or photographing on campus without a film permit (excludes incidental, non-obtrusive shoots) – UCI Student productions.
  • Allowing another entity to use space/resources. Space/resources booked by a client may not be transferred to another individual or entity.
  • Violating fire code (includes setup in inappropriate areas, using flames in inappropriate areas/manner, inappropriate candle usage, exceeding space capacities, etc.)
  • Setting up a structure that has not been approved by the required campus safety personnel.
  • Exceeding the 10’ height restriction for outdoor structures.
  • Using equipment that was set up for another organization.
  • Unauthorized use of a transportation device or parking a transportation device in an unapproved area.
  • Smoking on campus. All University facilities are tobacco free.
  • Failure to pay for services.

Level II Outcome of Infraction

  1. First-time Level II non-compliance, a verbal warning will be given and the group will receive a directive to stop non-compliant act.
  2. Any continued non-compliance after the verbal warning, the organization’s reservation status will be changed to “Not in Good Standing” and may result in loss of booking privileges for the remainder of the quarter and the next two consecutive quarters. Appeals can be submitted to the Student Center Board of Advisors. The form and instructions on how to appeal can be found below.

Level III Infractions

  • Intentional damage/vandalism of University property in relation to an event.
  • Collecting personal information such as credit card details (or trying to take credit payments onsite), social security numbers, and other sensitive identification information.
  • Bringing weapons or other dangerous items to campus as part of an event without obtaining permission through SCES and other UCI departments as appropriate.
  • Any client or third party using or distributing illegal substances.
  • Non-compliance with state gambling laws on University property.
  • Serving alcohol without appropriate approvals/permits and/or violating state liquor laws including serving alcoholic beverages to those under age.
  • Showing/using copyrighted material without obtaining the proper permissions.
  • Filming or photographing on campus without a film permit (excludes incidental, non-obtrusive shoots) – External Organizations (not registered as a student organization or campus department).
  • Student Code of Conduct violations.

Level III Outcome of Infraction

  1. First-time Level III violations result in immediate loss of booking privileges for the remainder of the current quarter and the following three quarters. Appeals can be submitted to the Student Center Board of Advisors. The form and instructions on how to appeal can be found below.

Appeal Process and Timelines for Submitting:

An individual or organization who receives an infraction may appeal in writing within five days of receiving the violation notification. The appeal will be reviewed by the Student Center Board of Advisors. The board shall inform the applicant of the decision in writing within fifteen days of receipt of the written appeal.
